    Your GOVERNMENT, ELECTIONS AND INDIAN AFFAIRS COMMITTEE, to whom has been referred

 

HOUSE BILL 120

 

has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:

 

     1. On page 1, lines 16 and 17, strike "; CREATING A PRIVATE RIGHT OF ACTION".

 

     2. On page 2, strike lines 7 and 8.

 

     3. Reletter the succeeding subsections accordingly.

 

     4. On page 3, line 22, before the period, insert "to ensure that each service, program or activity conducted by the state agency, when viewed in its entirety, is readily available to, and usable by, individuals with disabilities".

 

     5. On page 3, between lines 22 and 23, insert:

 

          "D. A state agency shall not be required to take any action if the state agency can demonstrate that the action would result in:

 

                (1) a fundamental alteration in the nature of the services, programs or activities conducted by the state agency; or

 

                (2) an undue financial or administrative burden.".

 

     6. On page 4, line 2, strike "director" and insert in lieu thereof "chief accessibility officer".

 

     7. On page 4, line 3, strike "director" and insert in lieu thereof "chief accessibility officer".

 

     8. On page 4, line 7, strike "director" and insert in lieu thereof "chief accessibility officer".

 

     9. On page 4, line 8, strike "enforce the" and insert in lieu thereof "facilitate compliance with".

 

     10. On page 4, line 9, strike "upon" and insert in lieu thereof "for".

 

     11. On page 6, strike lines 6 through 19.

 

     12. Renumber the succeeding section accordingly.,

 

 

and thence referred to the JUDICIARY COMMITTEE.
